Versus
1. State Of Chhattisgarh Through Secretary Department Of Forest, Mantralaya, Mahanadi Bhawan, Naya Raipur Chhatisarh
2. Divisional Forest Officer, Koriya Forest Division, Baikunthpur, Distirct Koriya Chhattisarh
3. Khelsai Pandey, S/o Late Sampooran Ram, Aged About 22 Years R/o Vilalge Patrapoli, Baikuntpur, District Koriya Chhattisarh ---- Respondents For Petitioner :
Shri Pushkar Sinha, Advocate For Respondent/State :
Shri Dhiraj Wankhede, GA Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 29/07/2016 Heard.
2.
The only ground, which may require consideration in the matter, is that the wife of the petitioner is working as Patwari at Khadawan, whereas the petitioner, who is presently working as Forest Guard at Khadgawan and now by the impugned order, he has been transferred to Kotadol which is said to be about 200 Kilometers away. 3.
There is a policy of the State government to keep husband and wife at one place as far as possible subject to administrative exigency and public interest. 4, However, taking into consideration that large number of postings have been taken place by the impugned order, the petitioner may approach the transferring authority i.e. the Divisional Forest Officer, Koriya Forest Division, with the specific
ground, who may consider as to whether it is possible looking to the administrative exigency to keep the petitioner at the same place of posting or not. This would be subject to administrative exigency and requirement. The decision may be taken within a period of 15 days. For a period of 15 days , no coercive steps shall be taken against the pettiioner.
5.
With the aforesaid observation, this petition is finally disposed off. SD/- (Manindra Mohan Shrivastava) Judge Tumane
