The only ground to challenge the transfer order is that the petitioner is going to retire within a period of one year i.e. on 30.06.2017.

According to the Government Standing Policy, an employee, who is going to retire within a period of less than one year, may be either posted in the home district or in a place of his choice. 3.

According to learned counsel for the petitioner, there are no complaint or any departmental enquiry is pending against him so as to constitute acute administrative exigency for his shifting at the fag end of his service.

Considering that the petitioner is going to retire within a period of less than one year, respondent No.1 is directed to consider the petitioner's representation and take decision thereon within a period of three weeks. For four weeks, no coercive steps shall be taken against the petitioner. Protective umbrella shall inure to the petitioner subject to the submission of copy of this order before respondent No.1 within a period of 10 days from today. 5.
