The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.73/2014 registered in Police Station Azad Chowk, Raipur, District Raipur (C.G.) for offence punishable under section 420, 120-B, 306/34 of IPC.

As per the prosecution case, the applicant alongwith other coaccused have made publication for providing job and in lieu thereof deceased Abhay Jain deposited Rs.3 lakhs in the account of the applicant and the other co-accused Mahesh Gupta. Thereafter when the job was not provided and when money was asked back, it was refused. Therefore, Abhay Jain committed suicide.

Learned counsel for the applicant submits that the applicant himself is a victim as he has paid amount to the other co-accused and he has not been benefitted in this case. He further submits that charge sheet has been filed, the applicant is in jail since 5/04/2016, therefore he may be released on bail.

Learned State counsel opposes the prayer for grant of bail and

submits that bail of the similarly placed co-accused has been dismissed by this court in M.Cr.C. No.3991/2016 on 25/07/2016. 5.

Perused the case diary and the memorandum statement as also suicide note of the deceased. Considering the same it appears that the applicant along with other co-accused has received the amount to provide job to the deceased and when the job was not provided and the amount was not repaid back, therefore he committed suicide. Considering the nature of allegation and the way the organized crime has been done, this court is not inclined to release the applicant on bail. 6.
