1. We have considered the pleadings in this writ petition. We have heard the learned counsel for the petitioner, the learned Additional Advocate General and the learned counsel appearing for the Municipal Corporation, Korba.
2. The sum and substance of this writ petition is that certain activities in
buildings meant for the upliftment of the woman folk are adverse to their interest. It is stated that a project with the name of Mahila Samriddhi Swawalamban Yojana was made as a Self Help Group Project for women and rooms were allotted to them to conduct shops. The title to those rooms vested with the Municipal Corporation, Korba. It is stated that the building is near the Tahsil office. The allegation of the petitioner is that those rooms are, in turn, occupied by unscrupulous males who even carryout activities of public assault, sexual exhibition and propagation of nudity. It is the further contention that the women folk are unable to properly utilize the facilities or even to go anywhere near the location.
3. Whatever we have stated hereinabove are on the basis of the pleadings and submissions on behalf of the petitioner. We record the submissions on behalf of the Municipal Corporation, Korba that any allotment in favour of males or occupation by males have now been cancelled and the Municipal Corporation, Korba has taken steps to evict them.
4. Law and order situation, protection of women and children, maintenance of public order and tranquility are fundamentally the duties of administration. Apart from the Commissioner, Municipal Corporation, Korba discharging his duties in that regard, the District Collector, Korba and the Superintendent of Police, Korba have to ensure this.
5. For the aforesaid reasons, the District Collector, Korba, the Superintendent of Police, Korba and the Commissioner, Municipal Corporation, Korba are hereby directed to ensure that the needful is done to secure law and order and to prevent the commission or attempt to commit any cognizable offence and also to extend such facility as are required to preserve public tranquility, peace and order.
