(2) This is an application filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the applicant, who is apprehending his arrest in connection with Crime No.141 of 2013 registered at Police Station Berla District Bemetara (C.G.) for the offence under Sections 420, 409, 467, 468 & 471/34 of IPC. (3) Learned counsel for the applicant seeks to withdraw this bail application with liberty to move an application for grant of regular bail before the Court below. He submits that looking to the nature of accusation of the accused, the Court below may be directed to consider
and decide his application for grant of regular bail on the same date. (4) Reserving the liberty as prayed for, the bail application is dismissed as withdrawn. If the applicant moves an application for grant of regular bail before the Court below, the same shall be considered and decided as early as possible.
