The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.11/2016 registered in Police Station Badgaon for offence punishable under section 307 of Indian Penal Code. 2.
As per the prosecution case, a report was made by Sukhbati Hurra against the applicant that on 16/04/2016 the applicant administered pesticide into the food of the child, thereby tried to kill the child. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no evidence is available against the applicant and the food has been sent for FSL and the FSL report is still awaited, therefore it is not clear whether any pesticide was administered in the food or not? Therefore, learned counsel submits that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the statement of the complainant/mother as also memorandum statement of the accused and recovery of pesticide was made. Considering the statement of mother as the child of 3 years was
tried to be killed, therefore considering the evidence available, this court is not inclined to release the applicant on bail. 6.
