Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 03/08/2016 The only ground of challenge to the transfer order is that the petitioner is going to retire within a period of nine months. 2.

Learned counsel for the petitioner submits that the policy of transfer states that where the Government employee is going to retire within a period of one year, he may be posted either to his home district or to a place of his option as provided in Clause 2.10 of circular dated 11/06/2016.

In view of the aforesaid policy of the Government, claim of the petitioner requires consideration. It is, however, found that the petitioner has filed this petition without preferring any representation.

In view of above, this petition is disposed off with a direction that in case, petitioner prefers representation within a period of 10 days, the authorities shall consider petitioner's representation in the light of its own policy and take decision in the matter within a period of three weeks from the date of receipt of copy of this order and representation.

For a period of four weeks, no coercive steps shall be taken against the petitioner.
