Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 04/08/2016 The petitioner has challenged the transfer order on the ground that at present, the place where the petitioner is posted i.e. Durg, the wife of the petitioner is also posted at the same place. The petitioner is working as Fisheries Inspector and his wife is working as Shiksha Karmi at Block - Patan, Durg. 2.

The petitioner was transferred to Durg vide order dated 15/07/2014 and the petitioner joined at the present place. The petitioner has completed almost two years at the present place of posting. The place, where the petitioner is now being transferred i.e. Bemetara is 77 kms away.

Considering that there a policy to post the husband and wife at a same place as far as possible, subject to administrative exigency, petitioner's claim may be considered and decision may be taken by the authorities in four weeks.

If no one has jointed in place of the petitioner, for a period of four weeks, no coercive steps shall be taken against the petitioner. 4.
