This petition has been brought being aggrieved by the order dated 07.02.2020, passed in Case No. 19-A of 2015, by the First Civil Judge Class-II, Durg, District - Durg (C.G.), by which the opportunity of the petitioner/defendant to produce evidence was closed.

Considered on the submissions made and perused the impugned order. After due consideration, I am of this opinion that the petitioner/defendant should be given at least one opportunity to produce evidence for the reason that it is necessary for the
Page No.2 complete adjudication of the dispute between the parties. 3.
Therefore, this petition is disposed off at motion stage. The impugned order dated 07.02.2020 is set-aside and the petitioner is directed to give appearance before the Court on 16.03.2020 and on that date, the learned trial Court is directed to fix the date for production of defendant evidence. It is made clear that no further opportunity shall be given to the petitioner. 4.
Accordingly, this petition is disposed off.
