1. By the impugned order, petitioner's application under Section 311 of CrPC has been rejected finding no merit and it has further been held that prosecution witnesses i.e. P.W. 4 and P.W. 5 have already been cross-examined on behalf of the petitioner/accused, therefore, no permission can be granted for re-examination of P.W. 4 and P.W. 5 which has been sought to be challenged in the instant petition.
2. Heard learned counsel for the parties at length and perused the records.
3. After hearing learned counsel for the petitioner at length, I am satisfied that petitioner/accused has already been granted full opportunity to cross-examine P.W. 4 and P.W. 5 and no additional opportunity can be granted to the petitioner/accused to further cross-examine them. As such, I do not find any merit in the instant petition.
4. The instant petition, being devoid of merits, stands accordingly dismissed in limine. No cost(s).
