Agrawal Order On Board 04/12/2020 (1) Learned counsel for the petitioner would submit that information of the initiation of the confiscation proceedings has been initiated to the trial Magistrate on 10.2.2020 and, therefore, bar under Section 47-D of the C.G. Excise Act, 1915 would apply and in that case petitioner be given liberty to move an application for grant of interim custody before the Collector/Confiscating Authority.
(2) Be that as it may, the petitioner is at liberty to move an application for interim custody before the Collector and it will be considered and decided strictly in accordance with law.
