The transfer order dated 23-07-2016 is challenged on the sole ground that the petitioner is going to retire on 30-09-2016. It is submitted that in view of the State Government's Policy, where a government servant is going to retire within a period of one year, he is to be posted only in the home district or a place of his option, therefore, petitioner's claim requires consideration. 3.

However, it is found that the petitioner has not filed any representation.

In view of above ground raised in the petition, it is directed that in case, the petitioner prefers representation within a period of 10 days from today, the transferring authority shall consider the petitioner's representation keeping in view the policy of the government in respect of those, who are going to retire within a period of less than one year as stated in clause 2.10 of the transfer policy dated 11-06-2016 and appropriate decision within a period of four weeks for the date of receipt of representation.

For a period of four weeks, no coercive steps shall be taken against the petitioner.
