2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.5/2012, registered at Police Station AJAK Surajpur, District Surajpur (CG) for the offence punishable under Sections 147, 148, 149, 294, 506-B and 302 of IPC read with Section 3(1) (x) and 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. Considering the nature of allegations against the applicant and

MCRC No. 1727 of 2019 for the fact that he was absconding for nearly 6 years, this Court is not inclined to release the applicant on regular bail.

4. The co-accused persons have been allowed bail in Criminal Appeal No.22/2017 based on the nature of evidence adduced against them during the trial, therefore, that will not assist the applicant in the present application filed under Section 439 of Cr.PC.

5. Let the trial Court decide the Sessions Trial at the earliest.
