1. The challenge in the present writ petition is to the Annexure P-1 dated 09.02.2021 whereby the petitioner has been ordered to be posted in the office of Block Education Officer, Chhura, District Gariyaband.

2. The only apprehension that petitioner has is that at the office of Block Education officer, Chhura the post of Assistant Grade - III is not lying vacant and thereby if the petitioner is posted there being the difficulty in

releasing the salary of the petitioner and secondly he could be treated as surplus and would be subjected to frequent transfers or change of posting.

3. The counsel for the petitioner submits that he has already complied with the order and has joined at the office of Block Education Officer, Chhura. At the same time he has also approached higher authorities in the department by way of representation highlighting the apprehension of the difficulties that petitioner might face.

4. Given the facts and circumstances of the case, the writ petition at this juncture stands disposed of directing the District Education Officer i.e. respondent no.3 to immediately look into the representation of the petitioner and to redress the grievance that he has in accordance with rules and regulations governing the field.

5. Let an appropriate decision be taken at the earliest preferably within a period of 60 days.

6. The petitioner would be at liberty to make a fresh representation to the respondent no.3 highlighting his grievance within a period of 10 days from the date of receipt of copy of this order in addition to any earlier representation that he has made, if any.

7. With the aforesaid observations, the present writ petition stands disposed of.
