Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 10/08/2016 At the outset, Shri Kale points out that there is a remedy of statutory appeal provided under Section 7 (7) of Payment of Gratuity Act,1972 against the order of controlling authority and the petitioner has filed this petition without exhausting alternative remedy.

In view of above, I am not inclined to entertain this petition. The petition is accordingly dismissed with liberty to file statutory appeal before the competent authority.

Certified copy of Annexure P/1 be returned to the counsel for the petitioner after retaining photo copy of the same.
