This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested in connection with Crime No.305 of 2014, registered at Police Station-Lormi, Distt.Mungeli (C.G.), for the offence punishable under Sections 302, 147, 148 and 149 of the IPC.

Case of the prosecution, in brief, is that, the present applicants along with other co-accused persons murdered Nohar Sahu on 19.9.2014 by sharp edged weapons and thereby committed the aforesaid offence. 3.

Learned counsel for the applicant would submit that applicants have not committed any offence and subsequently their names have been

added in the charge-sheet by way of filing the additional charge-sheet. Initially their names have not been mentioned in the F.I.R., as such, they have not committed any offence and they are in jail since 9.6.2015. 4.

Learned State counsel would oppose the bail application. 5.

I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence; supplementary statements of the prosecution witnesses, the manner in which the deceased was subjected to grievous injuries in his neck by sharp edged weapons and material collected by the prosecution, this Court is not inclined to release the applicants on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
