The transfer order is under challenge on the ground that while passing transfer order, the policy of keeping husband wife together, as far as possible and subject to administrative exigency, has not been kept in view.

Learned counsel for the petitioner submits that the petitioner is posted as Assistant Soil Conservation Officer and his wife is posted as

-2Shiksha Karmi Grade-II at Kondagaon. Now, the petitioner is being transferred to Pankhajur, District Kanker, which is 250 km. away from the present place of posting.

He submits that according to the Government Policy, his case requires consideration.

Considering that there is a policy of the Government to keep the husband wife together as far as possible, the petitioner's case requires consideration as per provision contained in Clause 6 of the transfer policy dated 11.6.2016.

It is, however, found that the petitioner has not preferred any representation. Therefore, it is directed that if the petitioner prefers representation within ten days from today, the respondent No.1 shall consider and decide the same within a period of three weeks from the date of receipt of representation. For a period of four weeks, if any other person has not joined in the place of petitioner, no coercive steps shall be taken against the petitioner.

The petition is accordingly disposed off.
