The applicant has preferred this second bail application for grant of bail as he is arrested in connection with Crime No.13/2017 registered at Police Station Jainagar, District Surajpur for offences under Sections 363, 366, 376 (d)/(g), 306 and 201/34 of the IPC and Section 4 of the POCSO Act, 2012.

The first bail application, bearing M.Cr.C.No.4059 of 2017, in respect of the present applicant, was dismissed as withdrawn by order dated 22-11-2017.

The applicant, being the father of the main accused Anil Kumar, was instrumental in instigating his son to eliminate the deceased. On a prior occasion the deceased was kidnapped by Anil Kumar and his friends and was subjected to forcible sexual intercourse. Thereafter, the family members of the applicant were imposed fine of Rs.45,000/-. In the suicide note the deceased has mentioned the applicant's name as one of the person who was instigating the main accused Anil Kumar to eliminate and torture her. 4.

Having regard to the facts and circumstances of the case and particularly considering the nature of allegation, this Court is not inclined to release the applicant on regular bail. 5.

As an upshot, the instant bail application is dismissed. However, the trial Court is directed to expedite the trial. Sd/- Judge Prashant Kumar Mishra Gowri
