1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.60/2015 registered at Police Station Kasdol, Baloda Bazar-Bhatapara, for the offence punishable under Sections 420, 409 read with Section 34 of the IPC, 3 and 7 of the Essential Commodities Act.
2. Case of the prosecution, in brief, is that the applicant being the Salesman of Seva Sahkari Samiti, Khaira, while running the fair price shop committed irregularities and misappropriated the governmental money, and thereby committed the offence.
3. I have heard learned counsel for the parties and perused the case diary.
4. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in the case. The Manager and the Secretary of the Society have already been granted bail by this Court vide orders dated 7-7-2015 and 15-7-2015 passed in M.Cr.C.
Nos.3129/2015 and 3285/2015, respectively. FIR has been made on 23-12015 and the applicant has been arrested on 21-5-2015. Charge sheet has been filed and no useful purpose will be served by detaining the applicant in jail.
5. On the other hand, learned State counsel opposes the application.

Taking into consideration the nature and gravity of offence, role of the present applicant, the fact that co-accused persons have already been released on bail and the applicant is in jail since 21-5-2015, I am of the view that it is a fit case to enlarge the applicant on regular bail. Accordingly, the application is allowed.
7. It is, therefore, directed that the applicant be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court for his appearance as and when directed.
