Order On Board 29/07/2015 Heard.

The applicant is apprehending his arrest in connection with Crime No.259/15 registered at police station Durg, CG for alleged commission of offence under Section 498 (A) of IPC & Section 4 of Dowry Prohibition Act. 2.

Case of the prosecution is that the applicant has brutally beaten up his wife and thereby committed cruelty on her.

Learned counsel for the applicant submits that the allegations are exaggerated. He submits that there were minor disputes between the husband and wife and thereafter wife has been living separately. He submits that attempts of conciliation of dispute have been failed, therefore, the applicant has filed application for restitution of conjugal rights and report has been lodged. 4.

On the other hand, learned State counsel submits that certain injuries were found on the person of the complainant / wife and she remained admitted in the hospital for four days, therefore, applicant is not entitled to grant of anticipatory bail.

Taking into consideration the material that wife of the applicant remained admitted in the hospital due to certain injuries which according to her was inflicted by the applicant, I am not inclined to grant bail to the applicant. The application is therefore rejected.
