1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.18/2016 registered at P.S. Nagarnar, Distt. Bastar (C.G) for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. As per the prosecution case, on 06.02.2016 the applicant who was travelling in a Bus was found in possession of 22 Kgs., of Ganja along-with other co-accused.
3. Learned counsel for the applicant would submit that the applicant has been falsely implicated as Rosnamcha Sanha and weighment Panchnama reflect different timings, therefore, it would go to show that the applicant has been inculpated. He prays for releasing the applicant on bail.
4. Per contra, learned State Counsel opposes the bail.
5. On perusal of case diary statements, prima facie it appears that from the possession of applicant, 22 Kgs., of Ganja has been recovered.
6. Looking to the quantity of Ganja allegedly recovered from the possession of applicant, I am not inclined to release the applicant on bail. Accordingly the bail application is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
