Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 30/10/2017
1. Learned counsel for the petitioner would submit that vide order dated 26.09.2017, the petitioner who is working as Head Constable in District Balrampur has been transferred to District Jashpur by showing that he has made a request for transfer wherever the petitioner has never applied for transfer. He would submit that, even
otherwise, the transfer has been issued during ban period.
2. Considering the entire facts situation of the case, the writ petition is disposed of with a direction that in the event the petitioner submits representation before the I.G. Sarguja Range, respondent No.3 within a period of one month from today, the said respondent shall consider and decide the representation keeping in view the contents of the representation as also the submission, in accordance with law and on its own merits at the earliest preferably within two months.
3. Till the petitioner's representation is decided, he shall be allowed to continue at his present place of posting.
4. It is also made clear that if any administrative exigency impede the petitioner's relieving, the petitioner shall be informed in writing. It will also remain open for the respondents to reconsider the issue of transfer on account of any administrative exigency.
