The transfer order dated 02-07-2016 (Annexure P-1) has been challenged on the ground that the petitioner has been transferred to Saleh (Dondi Block) which is about 50-55 Kilometers away from the place of posting of petitioner's wife. Earlier, the petitioner was posted at Kochera, Block Dondi Lohara which is about 5 Kilometers from Badgaon. It is submitted that even upon promotion, in accordance with government policy, husband and wife have to be kept together subject to administrative exigency. The petitioner has preferred representation also raising his grievances.

In view of above, as there is a policy of the government to keep husband and wife together as far as possible subject to administrative exigency, the transferring authority shall consider and decide the petitioner's representation within a period of four weeks from the date of receipt of a copy of this order. 4.
