The petitioner contends that the petitioner was working in Mata Mahamari Unit, Ambikapur whereas in the order of transfer dated 14/02/2020 his place of posting has been shown as Mata Mahamari Unit, Raigarh, thereby further posting has been made. After closer of the said scheme the petitioner has been posted at Veterinary Hospital, Saskoan, Dharamjaigarh, Raigarh. 2.
Learned counsel for the petitioner submits that the petitioner was shown
wrongly posted at Raigarh whereas he was posted at Ambikapur. It is stated the transfer has been made to Raigarh taking into fact the petitioner is posted at Raigarh which is wrong. It is contended it has been done with the others had the petitioner's posting would have been shown at Ambikapur he would have been posted at Ambikapur, therefore the petitioner has made an application Annexure P-4 to correct the wrong facts so that the petitioner can be posted at Ambikapur. 3.
Considering the submission, if it is correct that the place of petitioner was not at Mata Mahamari Unit, Raigarh but it was at Ambikapur then certainly order of transfer dated 14/02/2020 suffers with wrong facts. Under these facts as the transfer order shows that after closer of the Mata Mahamari scheme persons who were placed in the particular district have been amalgamated and adjusted in the said district only, if in the case of the petitioner wrong posting has been shown then the petitioner's case needs to be reconsidered.
Under these circumstances, since the petitioner has made an application by Annexure P-4 to the Secretary, Veterinary Department case of the petitioner may also be considered with such factual aspect and earlier place of posting may be corrected accordingly and accordingly the placement orders may be passed as it has been done with others. Since the petitioner has already filed an application, same may be decided within a period of 45 days. Considering the aforesaid facts, till then transfer order dated 14/02/2020 in respect of the petitioner shall not be given effect to. 4.
