1. Heard on prayer for leave to appeal.

2. Taking into consideration the submission of learned counsel for the appellant that despite emphatic statement of the prosecutrix that the appellant had entered into physical relation with the accused only on the assurance of marriage, we are inclined to grant leave to appeal.

3. Accordingly, CRMP is allowed and the case be registered as an acquittal appeal and be listed for further orders.

4. CRMP is accordingly disposed off.
