Hon'ble Shri Justice P. Sam Koshy Order on Board 18/05/2020

1. The claim of the petitioner in the present writ petition seems to be non releasing payment by the respondents for certain alleged supply of sand, bricks and moorum made by the petitioner to the respondents.

2. Perusal of records would show that there is no written agreement or a contract entered into between the petitioner and the respondents. In the absence of any agreement existing between the parties, this Court finds it difficult in exercising of extraordinary writ remedy. The normal remedy available for the petitioner would be filing of a civil suit or by approaching the respondents by making suitable representation.

3. Reserving the right of the petitioner to approach the authorities for ventilating his grievance, the writ petition accordingly stands disposed of.
