Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 10/08/2016 Heard on admission The transfer order is under challenge mainly on the ground that ever since 2009, the petitioner has remained posted either in scheduled area or in core scheduled area. It is stated that now by impugned order, the petitioner is again being transferred to core scheduled area without considering the petitioner's posting to nonscheduled area as per guidelines dated 03.06.2015 in the matter of

-2transfer and posting in scheduled areas.

It is found that ever since 2009, the petitioner has remained posted in scheduled area or in core scheduled area and now he is again being transferred to another Tahsil which in core scheduled area, therefore, the claim of the petitioner requires consideration. 3.

It is, however, found that the petitioner has not preferred any representation in terms of transfer policy and has rushed to this Court. Therefore, all that can be done is that in case, the petitioner prefers representation to the State Government within a period of ten days from today, the State Government shall consider and decide the same within a period of four weeks. For a period of four weeks, no coercive steps shall be taken against the petitioner. 4.

The petition is accordingly disposed off.
