2. The challenge in the present writ petition is to the order dated 12.01.2021 (Annexure P/1) wherein the Fair Price Shop which was being run by the petitioner at Gram Panchayat-Ranpa, Tahsil Pandariya Distt. Kabirdham (C.G.) was suspended by the respondent No. 3.

3. Learned counsel for the petitioner submits that the said suspension order was passed by not giving any opportunity of hearing to the petitioner and on the wrong facts and ground the order has been passed. He further submits that no opportunity of hearing is being given to the petitioner despite the fact that the considerable time has been passed.

4. Order 16 Rule 1 of the Chhattisgarh Public Distribution System (Control) Order, 2016

contemplates that the time limit for redressal of the cases of the suspension or cancellation shall not exceed three months. Since the suspension order was passed on 12.01.2021, as on today considerable period appears to have been passed, therefore, the SDO Pandariya is directed to decide the case of the petitioner within a further period of 30 days from the date of receipt of copy of this order, after giving an opportunity of hearing to the petitioner.
