(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 36/2014 registered at Police Station Raghunathpur, District Balrampur for the offence punishable under Sections 376 of the Indian Penal Code & under Section 4 of Protection of Children from Sexual Offence Act, 2012.

(2) Taking into consideration the facts & circumstances of the case and the manner in which applicant is said to have committed sexual intercourse with the prosecutrix, who is said to be minor girl, aged 7 years, on the date of offence, which is duly supported by medical evidence; I am not inclined to release the applicant on bail.
