1. The applicants have preferred this application for grant of anticipatory bail, as they apprehend their arrest in connection with Crime No.107/2020, registered at Police Station Police Chowki Manipur, P.S. Ambikapur, District Surguja C.G. for offences punishable under Sections 3 & 4 of the Dowry Prohibition Act, 1961.
2. Marriage of applicant's son was fixed with the daughter of the
MCRCA No. 426 of 2020 complainant, however, before the marriage could be solemnized, applicant's son Chandra Shekhar Choudhari married with some other girl at Arya Samaj Temple. Thereafter the present complaint was filed alleging that the marriage did not happen because of demand of dowry by the applicants.
3. Learned State counsel would oppose the prayer for grant of anticipatory bail.
4. It appears that parents of the girl with whom the marriage was fixed had moved no objection before the Sessions Court, therefore, considering entire fact situation of the case, this Court is inclined to extend the benefit of anticipatory bail.
5. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicants, they shall be released on anticipatory bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (I) they shall make themselves available for interrogation by a police officer as and when required;
(ii) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
