Radhakrishnan , Chief Justice 13.11.2017 The petitioner challenges a decision of the Central Administrative Tribunal. He has invoked Article 227 of the Constitution of India. Earlier, the petitioner faced an adverse decision at the hands of the Tribunal. He challenged it before this Court by instituting WPS- 2436 of 2016. When that petition came up for consideration, that was sought to be withdrawn with liberty to file fresh representation before the respondents/SECR and its officials. The said writ petition was therefore, dismissed as withdrawn, as per Annexure P/9 order dated 22.08.2016. It appears that thereafter the petitioner pursued certain representations before the respondents.
wps- 5870 of 2017 Since that turned futile, he has again approached this Court by instituting the present Writ Petition challenging the very same order that was the subject matter of WPS- 2436 of 2016, which was dismissed as withdrawn on 22.08.2016. When no leave was granted or relief preserved when that Writ Petition was dismissed on 22.08.2016, which would enable the petitioner to again challenge the order dated 13.02.2015, this Writ Petition, necessarily, fails.
