The transfer order is under challenge on the ground that the petitioner is going to retire shortly within one year and three days. The other ground taken by the petitioner is that the petitioner and his wife both are suffering from various ailment and they are receiving treatment at Raipur.

The Government Policy to consider cases where the Government servants, who are gong to retire within one year, may not be applicable to the petitioner because it is more than one year. It is, however, considered that it is only three days more than one year. The other ground taken by the petitioner with regard to medical ailment.

All the aforesaid grounds do not warrant indulgence of the writ Court. The petitioner has preferred representation. As the policy requires consideration of representation against transfer, the competent authority shall consider and decide the petitioner's representation within a period of four weeks from the date of receipt of copy of this order. 4.
The petition is accordingly disposed off.
