1. The accused/applicant has moved this third bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 41/2016 registered at Police Station Berla, District Bemetara (C.G.) for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act.
2. The applicant's first bail application was dismissed as withdrawn by order of this Court dated 17.03.2016 passed in M.Cr.C. No. 1647 of 2016 with liberty to repeat the same after disposal of two criminal cases relating to excise offence.
3. The applicant's second bail application was also dismissed by this Court by order dated 07.07.2016 passed in M.Cr.C. 4047/2016 with liberty to file bail application in terms of para-1 of the order dated 17.03.2016.
4. Having heard learned counsel appearing for the parties, having regard to the facts & circumstances of the case, I do not find any change in circumstances to entertain this third bail application. Accordingly, the third bail application is rejected. However, the applicant is at liberty to move an application after disposal of two criminal cases relating to excise offence is disposed of in terms of the order dated 17.03.2016.
