The only ground to challenge the transfer order is that the petitioner is going to retire in less than one year. As per clause 2.10 of the Circular dated 11.06.2016, those Government employees who are going to retire within less than one year are required to be posted either in their home district or to a place of their option.

Considering the aforesaid ground that the petitioner is going to retire in the month of June, 2017, which is less than one year from the date on which the transfer order was passed, the petitioner's case requires consideration.

However, it is found that the representation has not been preferred by the petitioner, therefore, it is directed that if the petitioner prefers representation within a period of 10 days from today, the same shall be considered and decided in accordance of their own Policy in respect of those who are going to retire within less than one year, within a period of four weeks. For a period of four weeks, no coercive steps shall be taken against the petitioner provided no one has joined against the place of petitioner till date. 4.
The petition is accordingly disposed off.
