The ground of challenge against the transfer order is that the petitioner is presently posted in Block Gunderdehi, which is scheduled area and now, he has again been transferred to another block within the same district, which is also in the scheduled area.

Referring to government policy dated 03-06-2015 and 11-06-2016 in the matter of transfer to and from scheduled area, learned counsel for the petitioner contends that the petitioner is now eligible for being considered for transfer outside the scheduled area.

In view of the submission made by learned counsel for the petitioner and the aforementioned government transfer policy, the case of the petitioner requires consideration for posting outside the scheduled area. The petitioner has already

preferred representation. The transferring authority shall consider and decide the representation of the petitioner in accordance with government policy within a period of four weeks.

Learned counsel for the petitioner submits that in addition to above ground, some other grounds have also been raised.

The transferring authority shall also consider those grounds and decision be taken.
