Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 0 8 / 11 /201 (1) Plaintiff's opportunity to lead evidence has been closed by the impugned order.

(2) Learned counsel for the petitioner would submit that on 12.10.2017, the plaintiff could not appear for recording his evidence as he was suffering from acute diarrhoea on that day, therefore, he may be granted time to examine himself and his two other witnesses subject to payment of cost on the next date of hearing.

(3) I have heard learned counsel appearing for the petitioner. (4) Considering the cause shown by the petitioner in the petition, the petitioner and his two witnesses are directed to be examined by

the trial Court on 13.11.2017 subject to payment of cost of Rs.2,000/- payable to defendant No.1. It is made clear that no further time shall be granted to the petitioner for examination of witnesses. The defendant No.1 is at liberty to file application for modification, if any. (5) With the aforesaid observations, the writ petition stands disposed of.
