Minz, Dy.GA Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 12/08/2016 The transfer order is under challenge on the ground that the petitioner was posted in scheduled area for last 8 years and thereafter, by the impugned transfer order, he has again been transferred to another scheduled area to accommodate respondent No.4, who remained posted in the scheduled area for a period of 8 months only and he is being transferred on his own request. 2.
Considering that the petitioner has already remained posted in the scheduled area for a period of 8 years, his case requires consideration in terms of government transfer policy dated 03-06-2015 & 11-06-2016, wherein it was
provided that a government servant, who was posted in the scheduled area for a long time, his case required to be considered for being posted outside the scheduled area.

The petitioner has already preferred representation. The respondent authority may consider and decide the representation of the petitioner within a period of four weeks. In addition, there are other personal difficulties, which have been raised in the petition, the same may also be considered by the respondent authority.
