2. The petitioner's application under Section 85 of the Panchayat Raj Adhiniyam has been dismissed by the SDO (Revenue), Durg.
3. The petitioner has an alternative remedy of preferring an appeal before the Collector, therefore, the writ petition is not maintainable.
4. Accordingly, the writ petition is dismissed, as not maintainable. However, the petitioner may prefer a duly constituted appeal within a period of 15 days from today along with an application for grant of interim relief before the appellate authority. If such appeal/application is filed, the same shall be considered and disposed of by the said authority, at the earliest, preferably within a period of 03 months.
