The transfer order has been challenged on the ground that the petitioner has not completed one year of posting at Government Higher Secondary School, Badnara, where he actually joined on 07.08.2015.

The petitioner has been transferred to Government Higher Secondary School, Baijalpur which is about 70-80 km away from the present place of posting. It is found that though earlier transfer order was passed on 20.07.2015, the petitioner had joined on 07.08.2015. The transferring authority may consider whether

exigency warrant shifting in such a short period to other station though the same cannot be said to be too far away. 3.

If the petitioner prefers representation within 10 days from today before the transferring authority, the same shall be considered and decided within a period of two weeks. For two weeks, coercive steps shall not be taken provided no one has joined at the present place of posting of the petitioner.

The petition is accordingly disposed off.
