Learned counsel appearing on behalf of petitioner would submit that the Sub-Divisional Officer (Revenue), Mahola has passed an order in favour of the petitioner on 07.07.2017 directing removal of encroachment by respondent No. 1- Milan Kumar. However, respondent No. 5- Nagar Panchayat has issued a notice to the petitioner on 16.10.2017 to vacate his shop, being aggrieved against which this writ petition has been preferred by the petitioner.

I have heard learned counsel for the petitioner.

Be that as it may, the petitioner is at liberty to make an application before the Sub-Divisional Officer (Revenue), Mahola for redressal of his grievances within three days from today and, in that event, the SubDivisional Officer (Revenue), Mahola shall consider and decide the petitioner's application and pass an appropriate order expeditiously preferably within a period of seven days from the date of receipt of copy of this order.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
