Heard learned counsel for the Petitioner and learned counsel for the Respondents.

This writ application was filed in the year 2001. The issue was refusal by the Respondent-company to accept an application for voluntary retirement of the Petitioner under the voluntary retirement scheme, prevalent then. 3.

The fact stands as of today that the Petitioner superannuated even otherwise way back on 28.02.2001. This issue has become a dead issue. No adjudication is required to be made.

If there are certain claims and dues which are outstanding against the Respondent-company, the Petitioner is free to approach the competent

authority, who will examine the same and settle the issue, if such entitlement is found to be order or else a speaking order will be passed on such claim and communicated to the Petitioner.

Such a decision must be taken within three months of filling of an application with a copy of this order.

Writ has no merit. It is dismissed.
