The petitioner would assail the order passed by the District Judge, Durg, whereby his appeal against the order passed by the Estate Officer directing his eviction from the residential premises alloted by the respondent while the petitioner was in service, has been dismissed.

Shri Kashif Shakeel, learned counsel for the respondent, would submit that the petitioner has already handed over the vacant possession of the accommodation and the amount of security deposit has also been refunded to him after making necessary deduction, in accordance with law.

In view of the above, nothing survives for adjudication in this petition. Accordingly, the writ petition is dismissed. However, if any other cause of action still survives in favour of the petitioner, he would be at liberty to move afresh before this Court.
