This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.22/2015 registered at Police Station-Narayanpur, Distt.Narayanpur (CG), for the offence punishable under Sections 370 and 371/34 of the IPC.

Case of the prosecution, in brief, is that, the present applicant and co-accused Rajman Kawde recruited 7 girls and taken them to Tamalnadu by inducement and thereby committed the offence of trafficking. 3.
Learned counsel for the applicant would submit that the applicant has not committed any offence and has been falsely implicated in this case. He would further submit that co-accused Rajman Kawde has been admitted to bail by this Court vide order dated 24.6.2015 in M.Cr.C.No.2826 of 2015
and case of the present applicant is similar to that of co-accused, therefore, he may be released on regular bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard counsel appearing for the parties and perused the case diary.

Taking into consideration the facts & circumstances of the case, further taking into consideration the nature & gravity of offence, age of the girls, their statements, role of the present applicant in offence in question and the fact that bail was granted to co-accused Rajman Kawde, I am of the opinion that present is the fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed. It is directed that on furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court for his appearance as and when directed, the applicant shall be released on bail.
