Hon'ble Shri Justice Rajendra Chandra Singh Samant Order on Board 19-05-2021Sd/-

1. Heard on the application filed under Section 439 of the Cr.P.C. This is the first bail application filed for grant of regular bail. These applicants have been arrested on 15.02.2021, in connection with Crime No.121/2020, registered at Police Station-- Bango, District- Korba, C.G. for offence punishable under Sections 379/34 of I.P.C.

2. It is submitted by the learned counsel for the applicants that the applicants are innocent and have been falsely implicated in this case. There is no case made out against these applicants. Charge-sheet has been filed after completion of investigation. Hence, it is prayed that these applicants may be granted bail.

3. Learned counsel for the State/non-applicant opposes the application and submissions made by the learned counsel for the applicant.

5. According to the prosecution case, it is alleged that some unknown persons committed theft of 40 liters of diesel from the vehicle of the complainant- Shivnarayan Yadav. These applicants and others have been arrested later on. Hence, this case.

6. Considered on the submissions and for the reason that the investigation is now complete and case is pending for trial, therefore, I feel inclined to allow this application.

7. Consequently, this application filed by the applicants under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on their furnishing a personal bond in the sum of Rs.25,000/- with two surety each in the like sum to the satisfaction of the concerned Court, for their appearance as and when directed.
