1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.674/2019 registered in Police Station Jamul, District Durg for offence under Section 457, 380 and 411 of the IPC.
2. As per the prosecution case, co-accused Jitu Chelak committed theft of ornaments and cash from the house of complainant Aftab Hussain and thereafter sold part of the stolen articles to the present applicant.
3. Learned State Counsel would oppose the prayer for grant of bail. However, he would submit that the concerned SHO has not reported
MCRC No. 2617 of 2021 any previous antecedents of the applicant.
4. Considering that the offences are triable by the Judicial Magistrate 1st Class, the applicant is in jail since 23.2.2021 and charge sheet has already been filed, I am inclined to release the applicant on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
