The respondent No.1 NIIT against whom the petitioner has sought relief in this writ petition is a private company, therefore, the writ petition is not maintainable because no writ can be issued against the private company, it not being a 'state' within the meaning of Article 12 of the Constitution of India.

3. Petitioner may move before the appropriate forum having jurisdiction over the matter.
