The transfer order is under challenge on the sole ground that the petitioner is being sent to a core scheduled area whereas the petitioner is aged about 57 years.

Learned Senior counsel for the petitioner submits that under policy dated 03.06.2015, in such cases, consideration has to be made

-2not to post an employee aged more than 55 years in core scheduled area, as far as possible.

It is found that the petitioner has remained posted at the present place of posting for the last 11 years. Therefore, he has definitely become due for transfer. However, considering the grievance of the petitioner, it will be open for the petitioner to make representation before the competent authority and if such representation is made, the same shall be decided in four weeks to consider whether the petitioner could be adjusted in any area other than present place of posting. 4.

The petition is accordingly disposed off.
