1) The appellant has preferred this appeal under Section 14 (A)

(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 as the appellant was arrested on 06.09.2019 in connection with Crime No.26/2019 for offence under Section 365, 294, 506-B, 323, 343, 384, 376 (D) of IPC and Section 3(2-5) of the SC/ST Act registered at Police Station- Ajak, Ambikapur, Surguja District- Surguja (C.G.).

2) After arguing for sometime, learned counsel appearing for the appellant seeks to withdraw this Criminal Appeal with liberty to file afresh as and when occasion arises.

3) Counsel for the State has no objection to the above prayer.

4) The complainant/victim was duly served with the notice and informed about the present proceedings. However, neither the complainant/victim is present in person nor is there any representation on her behalf.

5) Permission granted.

6) Accordingly, the Criminal Appeal is dismissed as withdrawn with the liberty as stated above.
