The transfer order is under challenge on the ground that while transferring the petitioner, the policy of the Government to keep husband wife together as far as possible and subject to exigency of service, has not been kept in view.

Learned counsel for the petitioner submits that the petitioner is posted at the present place of posting at Bhanupratappur and her husband is posted at Durgukondal in the same district. Now, by the impugned order, the petitioner has been transferred to a far and distant place whereas her husband has remained posted at Durgukondal. Thus, the petitioner will suffer severe hardship.

Considering that the petitioner has completed her normal tenure of service of four years, the petitioner has become due for transfer. However, I find that the petitioner has not submitted any representation but has filed this petition. If the petitioner submits representation within ten days from today, the transferring authority shall consider and decide the representation within a period of four week whether it is possible to adjust the petitioner and her husband at the same station or at nearby stations where the petitioner is being transferred or any other place as per the Government policy of posting husband and wife together.

The petition is accordingly disposed off.
