The transfer order is under challenge on the ground that though the petitioner substantively holds the post of lecturer, while working as In-charge Principal at the present place of posting, he has been transferred to another place against the post of In-charge Principal which the petitioner is not inclined to accept. 2.

The order does not cause any prejudice to the petitioner. It is not a case that the petitioner is being transferred against a post of which is lower than his substantive post.

On petitioner's own showing, he has already completed almost five years of posting at the present place. Therefore, the petitioner has become due for transfer. Therefore, I am not inclined to interfere with the transfer order. However, if the petitioner is not willing to accept the higher responsibility as In-charge Principal, the petitioner may represent the competent authority that he should be allowed to continue only on his substantive post of lecturer. 4.

With the aforesaid observation and liberty, the petition is dismissed.
